Terms, Conditions, Waiver, and Park Rules

Under South Carolina law, Crooked Oaks RV Park accommodates guests in a recreational vehicle park and campground setting. Guests and transient guests are subject to applicable South Carolina law, including Section 45-2-65 and the Lodging Establishment Act. The Park may refuse service, remove, or eject any guest or transient guest for lawful reasons, including nonpayment, violation of posted rules, illegal drug activity, disturbance of others, damage to property, or other reasons permitted by law. If removal becomes necessary, the Park will follow applicable South Carolina law, including any notice and refund obligations required by law.

I HEREBY WAIVE AND RELEASE, indemnify, hold harmless, and forever discharge ECH CROOKED OAKS LLC, doing business as Crooked Oaks RV Park, together with its owners, members, managers, employees, agents, contractors, representatives, affiliates, successors, and assigns (collectively, the “Park Parties”) from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my camping activities on the premises of Crooked Oaks RV Park in Horry County, South Carolina, provided that this waiver of liability does not apply to any acts of gross negligence or intentional, willful, or wanton misconduct.

I understand that the activities in which I will participate are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property, and/or death; that injuries can occur because of the condition of the land; and that the land may pose dangerous conditions due to snakes, insects, spiders, ditches, erosion, sharp rocks, culverts, fallen trees, branches, mud, or other natural and man-made hazards. On behalf of myself, my heirs, assigns, and next of kin, I waive all claims for damages, injuries, and death sustained by me or my property that I may have against the Park Parties arising from such activities.

By this Waiver, I assume all risk, take full responsibility for, and waive any and all claims of personal injury, death, or damage to personal property arising out of or related to camping and building a campsite on the land, using the land in any manner, including swimming, hiking, crafts, sports, fishing, campfires, field trips, and engaging in any outdoor or related activities on or off the premises.

This Waiver and Release contains the entire agreement between the parties concerning the subject matter of this Waiver and Release and supersedes prior written or oral agreements concerning the same subject matter. The provisions of this Waiver and Release may be waived, altered, amended, or repealed, in whole or in part, only by prior written consent of the parties.

I have read, understand, and fully agree to the terms of this Waiver and Release. I understand and confirm that by signing this Waiver and Release I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to me. My signature is proof of my intention to execute this complete and unconditional Waiver and Release of liability to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this waiver. This agreement and its terms and provisions will include any minors who accompany me or are under my care. I further agree that I shall assume responsibility for watching and caring for any minor’s safety and guarding against all hazards, natural or man-made, whether expressly mentioned in this Waiver and Release or otherwise.

Cancellation Policy

Nightly and Weekly Reservations
Cancellations made at least eight (8) days before arrival will receive a refund less a $35 cancellation fee. Cancellations made seven (7) days or fewer before arrival will receive a refund less a $100 cancellation fee. Cancellations made within forty-eight (48) hours of arrival, and no-shows, are nonrefundable.

Monthly and Extended-Stay Reservations
Cancellations made more than thirty (30) days before arrival will receive a refund less a $150 cancellation fee. Cancellations made thirty (30) days or fewer before arrival will receive a refund less a $500 cancellation fee. Cancellations made within seventy-two (72) hours of arrival, and no-shows, will result in forfeiture of the first month’s payment or deposit, subject to any refund required by law.

Shortening Monthly or Extended-Stay Reservations
If management approves a shortened monthly or extended-stay reservation, the Park may charge a $150 administrative fee.

No refunds will be issued for early departures, weather, changes in travel plans, vehicle or equipment problems, or removal for violation of Park rules, except to the extent South Carolina law requires the refund of any unused prepaid rent or occupancy charges. Management may, in its sole discretion, make reasonable exceptions or issue a future-stay credit for verified emergencies or other extenuating circumstances.

If available and approved by management, a guest may check in as early as 11:00 AM or check out as late as 1:00 PM for a $25 fee. Occupancy outside those approved times may result in the charge of an additional daily rate.

General Park Rules

  1. Guests assume responsibility for any damages or injuries caused by themselves, their children, visitors, and/or pets.
  2. Guest acknowledges and accepts all associated risks, agreeing to hold the Park harmless and indemnify the Park Parties against any such occurrences.
  3. Guests are not allowed to check in after 10:00 PM. Guests expecting a late arrival must contact the Park in advance for approval and instructions.
  4. The Park disclaims liability for personal injuries, as well as loss, theft, or damage to personal property or vehicles. Guests are expected to secure all personal property at all times.
  5. Management reserves the right to refuse reservations or service for any lawful, nondiscriminatory reason and to remove or eject any individual not adhering to established rules, policies, or applicable law.
  6. All visitors must check in. Please register at the Welcome Center, or, if after hours, at the guard shack upon arrival. Visitors must pay a $10 visitor fee per visit and sign any required waivers.
  7. Delivery of mail or packages to guests is permitted, but we recommend obtaining a post office box for address changes. The Park address is 1720 Hwy 544, Conway, SC 29526. All deliveries, including food deliveries, will be dropped off at the front office or, after 6:00 PM, at the guard shack.
  8. Parking passes must be prominently displayed by all guests and visitors while on the property.
  9. Campsite boundaries go from pedestal to pedestal.
  10. Motorhomes, RVs, and travel trailers must be maintained in good working order and appearance.
  11. Management retains the right to deny access to guests with vehicles deemed unacceptable or in disrepair.
  12. Tent camping is permitted exclusively on designated tent sites.
  13. Tents are limited to a maximum of two (2) per tent site, with an additional nightly fee of $10 per tent.
  14. No RV/Car Camping: All types of motorhomes, including Class B vans, are prohibited from being used as sleeping quarters on tent sites.
  15. Nightly, weekly, and vacation reservations are valid for a maximum of six (6) guests, limited to four (4) adults. Up to two (2) additional guests may be allowed with prior approval from management at a charge of $10 per night per additional guest, for a maximum of eight (8) overnight guests per site.
  16. A maximum of twelve (12) people are allowed at a site at any given time, including guests and visitors, unless management approves otherwise.
  17. Quiet hours are from 11:00 PM to 7:00 AM. Please refrain from loud noises, including gatherings, radios, televisions, and similar activities. We ask that all guests be considerate of others at all times.
  18. Laundry Facility is open from 6:00 AM to 11:00 PM. Last load at 10:00 PM. You may pay with debit card or the CleanPay Mobile App. Please clean up after use and respect the property of those around you. Contact Fowler Laundry Solutions for service issues.
  19. Visitors are welcome between 9:00 AM and 10:00 PM, provided they register beforehand.
  20. Overnight stays for visitors are prohibited; all visitors must vacate the premises by 10:00 PM unless expressly approved by management.
  21. Use of firearms, archery equipment, slingshots, paintball guns, blow guns, or any other type of projectile-launching device is strictly prohibited.
  22. Display of a firearm is strictly prohibited except as otherwise permitted by applicable law.
  23. Overnight parking or storage of boats, boat trailers, or other trailers is not permitted unless specifically approved by management.
  24. Tiki torches are strictly prohibited on the premises.
  25. Propane grills and propane fire pits are permitted.
  26. Only firewood may be burned in fire pits—no cardboard, garbage, or prohibited materials. We enforce all county and state burn bans. Any garbage or prohibited material left in a fire pit may be removed by staff and charged to the guest in the amount of $25.
  27. Rugs, screen canopies, and pop-up canopies may not remain on grass for an extended period of time. All canopies must be securely fastened at all times to prevent them from being blown or moved and causing injury or property damage.
  28. Blow-up mattresses, sleeping bags, and cots must remain indoors; outdoor use is prohibited.
  29. Maintenance on RVs or vehicles is only allowed in the case of a camping-related event or with management approval.
  30. Washing of RVs or vehicles on the property requires prior approval from management. Detailing is allowed only Monday through Thursday from 9:00 AM to 4:00 PM.
  31. Fireworks are prohibited.
  32. Use of any paint products or chemicals is prohibited.
  33. Clotheslines are not permitted.
  34. Hanging items from trees is prohibited.
  35. All sites must be maintained in a neat and clean condition throughout the duration of the stay.
  36. Each site allows for one (1) RV and a maximum of two (2) additional vehicles, unless otherwise approved by management.
  37. Household trash should be disposed of in tied trash bags at the end of your site or in the dumpster. Boxes must be broken down. No outside trash is allowed in the dumpsters.
  38. Household trash must not be left out after 12:00 PM or overnight. Curbside pickup is scheduled daily by 12:00 PM.
  39. Charging electric vehicles is prohibited anywhere on Park property except for golf carts charged in locations approved by management. Guests may not use Park electrical outlets or infrastructure for unauthorized vehicle charging or modify, tamper with, or alter any electrical equipment or infrastructure for charging purposes.
  40. Only golf carts, traditional pedal bicycles, tricycles, push scooters, and e-bikes with pedals are permitted on the premises. No other self-propelled vehicles are allowed except approved medical mobility devices.
  41. Golf carts must be operated only by persons sixteen (16) years of age or older.
  42. All permitted vehicles must be equipped with functional front and rear lights.
  43. Users of all permitted vehicles must adhere to designated pathways and the posted speed limits.
  44. Guests are required to operate vehicles responsibly and comply with all posted rules and regulations. The Park speed limit is 7 MPH unless otherwise posted. Constant, excessive, or unsafe speeding may result in suspension of riding privileges, removal from the Park, and/or other lawful action.
  45. Violation of vehicle or riding rules may result in revocation of riding privileges.
  46. Boats, boat trailers, landscaping trailers, construction trailers, dump trailers, car dollies, and similar equipment or work trailers are not permitted to be stored on a campsite unless specifically approved by management. Enclosed cargo trailers are permitted only when they fit completely on the concrete pad, are maintained in a neat condition, and remain closed when not actively being accessed. No trailer may be used as open or exterior storage, and no trailer or equipment may be parked on grass or on another campsite.
  47. The use of drones or remote-controlled machines is strictly prohibited on the property.
  48. Crooked Oaks RV Park is situated within a natural wildlife habitat. Guests are advised to supervise pets and small children due to the presence of coyotes, birds of prey, reptiles, and other wildlife.
  49. Landscaped, rocked, or designated natural areas are off-limits to guests.
  50. While pets are permitted, they may never be left outside unattended, and owners are expected to promptly clean up after them. Repeated violations of the pet policy may result in removal from the Park.
  51. All pets must be on a leash or in a fenced-in area to ensure their safety and the safety of others. Repeated violations of the pet policy may result in removal from the Park.
  52. By signing these Terms & Conditions, you are stating that your pet is not known to be aggressive. If, in management’s reasonable judgment, a pet exhibits aggressive behavior or presents a threat to persons or animals, the pet must be removed from the Park immediately, and management may require the guest to leave as well.
  53. All mail or packages received after check-out will be returned to sender unless other arrangements are made in advance.
  54. All guests are expected to maintain appropriate attire in all common areas of the Park, including the pool and surrounding facilities. Swimwear must be suitable for a family-friendly environment. Guests must wear appropriate cover-ups or clothing when traveling to and from the pool and when outside designated swimming areas. Management reserves the right to determine what constitutes appropriate attire and may ask guests to change or leave the area if these guidelines are not followed.
  55. A registered guest must be present for any visitor to use the pool area.
  56. Pool hours are 9:00 AM to 10:00 PM. Children under fourteen (14) years of age must be accompanied by an adult over the age of eighteen (18). Proper swimwear is mandatory. Children who require a diaper must wear a swim diaper while swimming or using the splash pad. Staff members are not trained or designated lifeguards. Glass items are strictly prohibited inside the pool area.

Monthly Guest Terms

  1. Monthly rent is due before the next month of stay begins. Please ensure full payment is submitted on time. Any unpaid monthly rent balance that remains outstanding more than five (5) calendar days after the due date will be subject to a one-time late charge equal to ten percent (10%) of the unpaid monthly site rent. Failure to pay may result in additional action, including legal fees and/or removal from the Park.
  2. No Subletting Your RV: By keeping reservations directly between the Park and the registered guest, the Park can maintain accurate records and uphold community standards.
  3. Maintain a Clean and Tidy Site: Please keep your RV space neat and free of clutter. Outdoor items should be organized, and no trash or debris should be left around your site. All non-camping equipment and personal items, such as storage bins, tools, and building supplies, must be put away, kept out of sight, or stored off-site. Any open trailers stored on your site must be completely empty. Trailers should not be used for general storage or to hold equipment, building materials, or personal belongings. Enclosed cargo trailers are allowed if they comply with the Park’s trailer rules, remain on the concrete pad, and are kept closed when not actively being accessed.
  4. Dispose of Trash by 12:00 PM Daily: All household trash must be bagged and placed in the designated collection area before noon each day to help keep the Park clean and pest-free.
  5. Honor the Weekly Mowing Schedule: On your scheduled mow day, please move any outdoor pet fencing, rugs, furniture, and other items off the grass by morning so our team can maintain the grounds.
  6. Respect the Visitor Policy: All visitors must be called in to the front office, must sign a waiver, and must pay a $10 fee per visit. It is your responsibility to make sure your guests are properly checked in before entering the Park. If a visitor does not properly check in and pay the visitor fee, the registered monthly guest will be responsible for that fee, and it may be charged to the guest account or site.
  7. Keep Your RV Looking Presentable: RVs must be in good repair, clean, and free of visible damage or deterioration. Please promptly fix any issues that affect the appearance of your site.
  8. Prevent Leaks and Vehicle Damage: Leaking vehicles or RVs are not allowed. Please address any oil, coolant, or water leaks immediately to prevent damage to Park grounds and driveways.
  9. Obey All Speed Limits: For the safety of everyone, please follow the posted speed limits throughout the Park. The Park speed limit is 7 MPH unless otherwise posted. Constant, excessive, or unsafe speeding may result in removal from the Park and/or suspension of riding privileges.
  10. Maximum Occupancy: Monthly reservations include a maximum occupancy of two (2) adults, four (4) children, and two (2) pets per site. Any additional adults, children, or pets beyond these limits must be approved by management and may incur an additional charge of $10 per day per person or pet.
  11. Follow Our Pet Policy: All pets must be on a leash at all times and supervised when outside. You are responsible for cleaning up after your pets immediately. No exceptions. Repeated violations of the pet policy may result in removal from the Park.
  12. Long-Term Application: Guests may be required to complete a Long-Term Application prior to check-in. Crooked Oaks RV Park reserves the right to deny or refuse any reservation if the information provided does not meet the rules, regulations, or expectations of ECH Crooked Oaks LLC.
  13. Monthly reservations require a minimum reservation of thirty (30) nights. If you depart before the end of your reservation, no refund will be due for unused nights unless management expressly agrees otherwise in writing or applicable law requires a refund. At management’s sole discretion, the Park may re-rate the stay using applicable nightly or weekly rates and may issue any resulting credit, less applicable fees, if that produces a lower overall charge.
  14. Deposit Required: All monthly reservations require a $500 security deposit. The deposit secures payment of unpaid rent, visitor fees, damages, excessive cleaning, pet-related charges, utility misuse, and any other amounts owed to the Park. The deposit is not automatically applied to rent unless the Park approves that application in writing. Any unused deposit balance will be refunded or credited within thirty (30) days after departure, less any lawful deductions.
  15. Refund Policy: We reserve the right to take up to thirty (30) days to process and issue refunds for any user credit, overpayment, deposit balance, or account balance for monthly guests.
