WAIVER AND RELEASE FROM LIABILITY FOR INDIVIDUAL OWNER FOR USE OF LAND AND CAMPING<\/p>\n
According to South Carolina law HB 3387, including Section 45-2-65, the legal status of guests staying in RV Parks and campgrounds clarifies guests are transient guests, not residential tenants. Park operators may remove a guest (or have them removed) if the guest: illegally possesses or deals in a controlled substance as defined and covered by Chapter 53 of Title 44; disturbs the peace, quiet enjoyment, or comfort of other persons; causes harm to the physical park; violates the posted park rules and regulations; or fails to make payment of rent at the rental rate agreed upon and by the time agreed upon. If the guest refuses to leave after being directed to do so, law enforcement may assist in removal.<\/p>\n
I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge ECH CROOKED OAKS LLC from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my camping activities on the premises of land owned by ECH CROOKED OAKS LLC in the County of HORRY, in the state of SC provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.<\/p>\n
I understand that the activities in which I will participate are inherently dangerous and may cause serious of grievous injuries, including bodily, damage to personal property and\/or death; that injuries can occur because of the condition of the land, and that the land may pose such dangerous conditions due to snakes, insects, spiders, ditches, erosions, sharp rocks, culverts, fallen trees, branches, snow, mud, or other natural and man-made hazards. On behalf of myself, my heirs, assigns and next of kin, I waive all claims for damages, injuries and death sustained to me or my property that I may have against the aforementioned release party to such activity.<\/p>\n
By this Waiver, I assume any risk, and take full responsibility and waive any and all claims of personal injury, death or damage to personal property and real property owned by ECH CROOKED OAKS LLC including but not limited to camping and building a campsite on the land, using the land in any manner, form or fashion, including swimming, hiking, crafts sports, field trips, fishing, campfires, and engaging in any outdoor activities or other related activities on and off the premises.<\/p>\n
This WAIVER AND RELEASE contains the entire agreement between the parties, and supersedes and prior written or oral agreements between them and concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only the prior written consent of all parties.<\/p>\n
I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My signature is proof of my intention to execute this complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this waiver. This agreement and its terms and provisions will include any minors who accompany me or are under my care. I further agree that I shall assume responsibility for watching and caring for minor’s safety and guarding against all hazards, natural or man-made, whether expressly mentioned in this WAIVER AND RELEASE or otherwise.<\/p>\n
ECH Crooked Oaks LLC Policies & Rules<\/p>\n
Cancellation Policy<\/p>\n
For nightly and weekly reservations, cancellations made at least eight days before arrival will receive a refund less a $35 cancellation fee. Cancellations made seven days or fewer before arrival will receive a refund less a $100 cancellation fee. Cancellations made within 48 hours of arrival and no-shows are nonrefundable.<\/p>\n
For monthly and extended-stay reservations, cancellations made more than 30 days before arrival will receive a refund less a $150 cancellation fee. Cancellations made 30 days or fewer before arrival will receive a refund less a $500 cancellation fee. Cancellations made within 72 hours of arrival and no-shows will result in the loss of the full first month’s payment or deposit. There will be a charge of $150 for shortening of monthly stays and extended stay reservations.<\/p>\n
No refunds will be issued for early departures, weather, changes in travel plans, vehicle or equipment problems, or removal for violation of park rules. Management may make reasonable exceptions or issue a future-stay credit for verified emergencies or other extenuating circumstances at its sole discretion.<\/p>\n
Check-In Time: 1:00 PM Check-Out Time: 11:00 AM<\/p>\n
Guests assume responsibility for any damages or injuries caused by themselves, their children, and\/or pets.<\/p>\n
Guest acknowledges and accepts all associated risks, agreeing to hold the Landlord harmless and indemnify against any such occurrences.<\/p>\n
Guests are not allowed to check in after 10 PM. If you arrive after 10 PM, you can check in when the morning staff arrives at 7 AM.<\/p>\n
The park disclaims liability for personal injuries, as well as loss, theft, or damage to personal property or vehicles.<\/p>\n
The management reserves the right to refuse reservations for any reason and evict any individuals not adhering to the established rules and policies.<\/p>\n
All visitors must check in. Please register at the Welcome Center, or if after hours, at the guard shack upon arrival. Visitors must pay a $10 visitor fee per visit and sign necessary waivers.<\/p>\n
Delivery of mail or packages to guests is permitted, but we do recommend getting a PO Box for address changes. 1720 Hwy 544 Conway SC 29526. All deliveries including food deliveries will be dropped off at the front office or guard shack.<\/p>\n
Parking passes must be prominently displayed by all guests and visitors while on the property.<\/p>\n
Campsite boundaries go from pedestal to pedestal.<\/p>\n
Motorhomes, RVs, or Travel Trailers must be maintained in good working order and appearance.<\/p>\n
The management retains the right to deny access to guests with vehicles deemed unacceptable.<\/p>\n
Tent camping is permitted exclusively on designated tent sites.<\/p>\n
Tents are limited to a maximum of two per tent site, with an additional nightly fee of $10 per tent.<\/p>\n
No RV\/Car Camping: All types of motorhomes, including Class B vans, are prohibited from being used as sleeping quarters on tent sites<\/p>\n
Our rates are valid for a maximum of 6 guest. Limited to 4 adults.<\/p>\n
A maximum of 12 people are allowed at a site at any given time. (For Gatherings)<\/p>\n
Quiet hours are from 11 PM to 7 AM. Please refrain from loud noises, including gatherings, radios, televisions, and similar activities. We ask that all guests be considerate of others at all times no matter the time of day.<\/p>\n
Laundry Facility is open from 6 AM to 11 PM. Last load at 10 PM. You can pay with debit card or Clean Pay Mobile App. Please clean up after you are done and respect the property of those around you. Contact Fowler Laundry Solutions for any service issues.<\/p>\n
Visitors are welcome between 9 AM and 10 PM, provided they register at the office beforehand.<\/p>\n
Overnight stays for visitors are prohibited; all visitors must vacate the premises by 10 PM.<\/p>\n
Use of firearms, archery, slingshots, paintball guns, blow guns or any other type of projectile launching device is strictly prohibited.<\/p>\n
Display of a firearm is strictly prohibited.<\/p>\n
Overnight parking or storage of trailers is not permitted unless approved by management.<\/p>\n
Tiki torches are strictly prohibited on the premises.<\/p>\n
Propane grills and propane fire pits are permitted.<\/p>\n
Only firewood can be burned in the fire pit – no cardboard or garbage. We enforce all county and state burn bans.<\/p>\n
We do not allow rugs or screen canopies on the grass for an extended period of time.<\/p>\n
Blowup mattresses, sleeping bags, and cots must remain indoors – outdoor usage is prohibited.<\/p>\n
Maintenance on RVs or vehicles is only allowed in the case of a camping-related event or with management approval.<\/p>\n
Washing of RVs or vehicles on the property requires prior approval from management. We will only allow detailing Monday through Thursday 9 AM to 4 PM.<\/p>\n
Fireworks are prohibited.<\/p>\n
Use of any paint products or chemicals is prohibited.<\/p>\n
Clotheslines are not permitted.<\/p>\n
Hanging of items from trees is prohibited.<\/p>\n
All sites must be maintained in a neat and clean condition throughout the duration of the stay.<\/p>\n
Each site allows for 1 RV and a maximum of 2 additional vehicles, unless otherwise approved by management.<\/p>\n
Household trash should be disposed of in tied trash bags at the end of your site or in the dumpster, boxes must be broken down. No outside trash is allowed in the dumpsters.<\/p>\n
Household trash must not be left out after 12 PM or overnight; curbside pickup is scheduled daily by 12 PM.<\/p>\n
It is strictly prohibited to charge any electric vehicle except golf carts within the premises or areas where this policy is enforced.<\/p>\n
Unauthorized use of electrical outlets or charging stations for charging electric vehicles is prohibited.<\/p>\n
Any modification or tampering with electrical infrastructure to facilitate charging electric vehicles is strictly prohibited.<\/p>\n
Only golf carts, traditional peddle bicycles, tricycles, push scooters, and E-Bikes with pedals are permitted on the premises. No other self-propelled vehicles are allowed unless approved vehicles for medical purposes.<\/p>\n
Golf carts must be operated by persons 16 years or older.<\/p>\n
All vehicles must be equipped with functional lights at both the front and rear for safety purposes.<\/p>\n
Users of all permitted vehicles must adhere to designated pathways and speed limits to ensure the safety of pedestrians and other vehicles.<\/p>\n
Guests are required to operate vehicles responsibly and comply with all posted rules and regulations.<\/p>\n
Violation of these rules may result in the revocation of riding privileges.<\/p>\n
Boats, boat trailers, cargo trailers, landscaping trailers, construction trailers, dump trailers, or car dollies must be accommodated on the concrete pad of the rented site; parking on grass or other sites is prohibited.<\/p>\n
The use of drones or remote-controlled machines is strictly prohibited on the property.<\/p>\n
ECH Crooked Oaks LLC is situated within a natural wildlife habitat; guests are advised to supervise pets and small children due to the presence of coyotes, birds of prey, and reptiles.<\/p>\n
Landscaped, rocked, or designated natural areas are off-limits to guests.<\/p>\n
While pets are permitted, we require that they are never left outside unattended, and owners are expected to promptly clean up after them.<\/p>\n
Additionally, all pets must be on a leash or in a fenced-in area to ensure their safety and the safety of others.<\/p>\n
By signing the Terms & Conditions, you are stating your pet is not known to be aggressive.<\/p>\n
All mail or packages received after check out will be returned to sender unless other arrangements are made.<\/p>\n
All guests are expected to maintain appropriate attire in all common areas of the park, including the pool and surrounding facilities. Swimwear must be suitable for a family-friendly environment. Guests must wear appropriate cover-ups or clothing when traveling to and from the pool and when outside of designated swimming areas. Management reserves the right to determine what constitutes appropriate attire and may ask guests to change or leave the area if these guidelines are not followed.<\/p>\n
Guests must be present for visitors to use the pool area.<\/p>\n
Pool hours are 9:00 AM to 10:00 PM. Children under 14 years of age must be accompanied by an adult over the age of 18. Proper swimwear is mandatory. Children who require a diaper must wear a swim diaper while swimming or in the splash pad. It is important to note staff members are not trained or designated lifeguards. Glass items are strictly prohibited inside the pool area.<\/p>\n
Monthly Guests Terms<\/p>\n
Monthly Rent Reminder: Payment for your monthly reservation is due prior to your next month of stay. Please ensure your full rent payment is submitted on time to avoid any further action, including possible legal fees and\/or removal from the park.<\/p>\n
No Subletting your RV: By keeping reservations directly between the park and the registered guest, we can properly screen occupants, maintain accurate records, and uphold our community standards. This helps prevent unauthorized use, reduces liability, and ensures that everyone on the property is accountable and respectful of park rules.<\/p>\n
Maintain a Clean and Tidy Site Please keep your RV space neat and free of clutter. Outdoor items should be organized, and no trash or debris should be left around your site. All non-camping equipment and personal items (such as storage bins, tools, building supplies, etc.) must be put away, kept out of sight, or stored off site. Any open trailers stored on your site must be completely empty. Trailers should not be used for general storage or to hold equipment, building materials, or personal belongings. Cargo trailers are ok if they are on the concrete and doors are closed.<\/p>\n
Dispose of Trash by 12 PM Daily All household trash must be bagged and placed in the designated collection area before noon each day to help keep our park clean and pest-free.<\/p>\n
Honor the Weekly Mowing Schedule On your scheduled mow day, please move any outdoor pet fencing, rugs, furniture, and other items off the grass by morning. This allows our team to maintain the grounds properly.<\/p>\n
Respect the Visitor Policy All visitors must be called in to the front office and they must sign a waiver and pay an $10 fee per visit. It is your responsibility to make sure your guests are checked in properly before entering the park.<\/p>\n
Keep Your RV Looking Presentable RVs must be in good repair, clean, and free of visible damage or deterioration. Please promptly fix any issues that affect the appearance of your site.<\/p>\n
Prevent Leaks and Vehicle Damage Leaky vehicles or RVs are not allowed. Please address any oil, coolant, or water leaks immediately to prevent damage to park grounds and driveways.<\/p>\n
Obey All Speed Limits For the safety of everyone\u2014especially children and pets\u2014please follow the posted speed limit signs throughout the park. This applies to all guests and visitors.<\/p>\n
Maximum Occupancy Monthly reservations include a maximum occupancy of 2 adults, 4 children, and 2 pets per site. Any additional adults, children, or pets beyond these limits must be approved by management and will incur an additional charge of $10.00 per day.<\/p>\n
Follow Our Pet Policy All pets must be on a leash at all times and supervised when outside. You are responsible for cleaning up after your pets immediately. No exceptions.<\/p>\n
Long-Term Application All guests are required to complete a Long-Term Application prior to check-in. Crooked Oaks RV Park reserves the right to deny or refuse any reservation if the information provided does not meet the rules, regulations, or expectations of ECH Crooked Oaks LLC.<\/p>\n
Monthly reservations require a minimum reservation of 30 nights. If you depart before the end of your reservation, you may be charged a standard vacation nightly rate for the nights you were here\u2014whichever results in the lesser charge.<\/p>\n
Deposit Required A $500 deposit is required for reservation over 30 days.<\/p>\n
Refund Policy We reserve the right to take up to thirty (30) days to process and issue refunds for any user credit, including but not limited to reservation cancellations, overpayments, or account balances for monthly guests.<\/p>\n
